By accessing and using NOLA PICKUP ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access to your account
• Ensuring you are at least 18 years of age or have parental consent

3. Prohibited Items and Conduct

The following items and activities are strictly prohibited on NOLA PICKUP:

3.1 Prohibited Items

• Firearms and Weapons: Guns, ammunition, explosives, knives (except culinary), or any weapons
• Illegal Drugs: Controlled substances, drug paraphernalia, or prescription medications
• Stolen Property: Any items that are stolen, counterfeit, or obtained illegally
• Adult Content: Pornography, adult services, or sexually explicit materials
• Hazardous Materials: Chemicals, flammable materials, or toxic substances
• Live Animals: Sale of live animals (except through verified adoption organizations)
• Human Parts: Body parts, organs, or bodily fluids
• Illegal Items: Any items prohibited by federal, state, or local law
• Counterfeit Goods: Fake designer items, pirated media, or trademark infringements
• Recalled Items: Products that have been recalled by manufacturers or government agencies

3.2 Prohibited Conduct

• Harassment, threats, or abusive behavior toward other users
• Fraud, scams, or misrepresentation of items
• Spam, unsolicited advertising, or commercial solicitation
• Impersonation of others or creation of false identities
• Interference with the Service's operation or security
• Collection of user data without consent
• Violation of any local, state, federal, or international law

4. Listing Requirements

When creating a listing, you agree to:

• Provide accurate descriptions, photos, and pricing
• Only list items you own or have authorization to sell
• Specify accurate pickup location within New Orleans area
• Respond to inquiries in a timely and professional manner
• Remove listings once items are sold
• Honor agreed-upon prices and terms with buyers

5. Transactions and Payments

NOLA PICKUP facilitates connections between buyers and sellers but is not party to transactions:

• All transactions occur directly between users
• Payment methods and terms are agreed upon by buyer and seller
• We do not process payments or handle money exchanges
• Users assume all risks associated with transactions
• We are not responsible for disputes, fraud, or non-delivery

6. Safety Guidelines

For your safety, we recommend:

• Meeting in public, well-lit locations
• Bringing a friend or informing someone of your meetup
• Inspecting items before payment
• Never sharing sensitive personal or financial information
• Trusting your instincts - if something feels wrong, walk away
• Reporting suspicious activity to local authorities and NOLA PICKUP

7. Content and Intellectual Property

By posting content on NOLA PICKUP:

• You retain ownership of your content
• You grant us a license to display, store, and distribute your content
• You represent that you own or have rights to post the content
• You will not post copyrighted or trademarked material without authorization
• We may remove content that violates these terms or applicable law

8. Account Termination

We reserve the right to suspend or terminate any user account or remove any content for any reason, at our sole discretion, including but not limited to:

• Violation of these Terms of Service
• Fraudulent or illegal activity
• Multiple reports from other users
• Abusive or threatening behavior
• Listing prohibited items
• Failure to comply with safety guidelines
• Any conduct we deem harmful to the Service or its users

Account termination may occur without prior notice and without the requirement to provide a reason. We do not issue refunds for any fees paid if an account is terminated for violating these terms.

9. Limitation of Liability

NOLA PICKUP is provided "as is" without warranties of any kind. We are not liable for:

• Disputes between users
• Quality, safety, legality, or accuracy of listings
• Actions or omissions of users
• Loss or damage resulting from use of the Service
• Unauthorized access to your account
• Service interruptions or technical issues

You use the Service at your own risk and agree to indemnify and hold harmless NOLA PICKUP, its owners, employees, and affiliates from any claims, damages, or losses arising from your use of the Service.

10. Reporting Violations

If you encounter prohibited content, suspicious activity, or terms violations, please report it immediately using the "Report" feature on listings or user profiles. We review all reports and take appropriate action.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of updated terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved in the courts of Orleans Parish, Louisiana.
